TRIBUNAL BOOK INSTRUCTIONS – BP1736/2024 This matter relates to a domestic building dispute involving defective installation of a refrigerated ducted heating and cooling system installed in 2019 at 19–19A Helene Street, Bulleen. The Tribunal Book must be prepared in accordance with the Tribunal’s directions and must present the case in a clear chronological and evidence-based format. ## 1. Purpose The Tribunal Book must clearly demonstrate: - Defective and non-compliant installation works - System underperformance and design/installation failures - Admissions by the respondent regarding system limitations - Evidence of regulatory/licensing concerns (including VBA involvement) - Loss and damage suffered by the applicant ## 2. Required Structure (MANDATORY) The Tribunal Book must be: - A single consolidated PDF with hyperlinked index - Pages numbered consecutively from page 1 - Indexed in a clear chronological and thematic order - Supplied in: - 2 hard copy sets - 1 editable PDF version ## 3. Evidence to Include ### A. Pleadings / Tribunal Documents - Application - Orders and directions - Any prior procedural documents ### B. Witness Evidence - Applicant witness statement (final version) - Any expert witness statements (if applicable) ### C. Correspondence (Critical Section) - All emails/letters between parties - Respondent admission regarding system airflow limitations and design constraints - Any settlement communications (including $40,000 offer discussion if in writing) ### D. Technical / Expert Evidence - Reports regarding: - Undersized ducting - Insulation non-compliance (R1.5 requirement not met) - Improper installation (duct support, sealing, access issues) - System sizing issues (14kW installed vs 28–30kW requirement) ### E. Regulatory Evidence - Any material from the Victorian Building Authority (VBA) - Evidence or correspondence regarding licensing or compliance concerns ### F. Photographic Evidence - Installation photos - Ceiling space / ductwork evidence - Defects and workmanship issues ### G. Financial Evidence - Rectification quotes - Replacement cost estimates - Any related loss documentation ## 4. Required Presentation Standard - Chronological where possible - Clear section headings and tabs - Hyperlinked index - No duplication of documents - Each document clearly labelled and referenced ## 5.
